Misdiagnosis Work With Our Firm to Fight for Your Best Possible Result

Misdiagnosis Lawyer in Brooklyn

Nearly 75 Years of Combined Experience Fighting for Brooklyn Misdiagnosis Victims

A misdiagnosis isn’t simply a bad medical outcome. It happens when a healthcare provider identifies the wrong condition entirely, sending a patient down a treatment path for a disease they don’t have while the condition they actually have goes unaddressed. That distinction matters legally, and it shapes how a claim is built. At Belushin Law Firm, P.C., we help Brooklyn residents understand exactly what happened to them and whether it rises to the level of medical malpractice.

If a wrong diagnosis caused you harm, New York’s filing deadlines limit how long you have to act. Call our misdiagnosis attorneys in Brooklyn today at (888) 918-9890 to schedule a free consultation, available 24/7 by phone or virtually.

Misdiagnosis vs. Failure to Diagnose: What’s the Difference?

These two claim types are often confused but involve different facts. A failure-to-diagnose claim arises when a provider misses a condition altogether. A misdiagnosis claim arises when a provider identifies the wrong condition. Both can cause serious harm, but the legal theory and the evidence differ.

A wrong diagnosis causes harm in two directions. The patient doesn’t receive treatment for the condition they actually have, and they may receive unnecessary or actively harmful treatment based on the incorrect label. Chemotherapy for a misidentified cancer, surgery for a condition that wasn’t there, or medication contraindicated for the actual underlying illness can all follow from a single diagnostic error.

How Diagnostic Errors Happen

Misdiagnosis most commonly occurs when a provider mistakes one condition for another. Overlapping symptoms make this easier than it sounds. Late-onset type 1 diabetes is frequently misread as type 2, leading to an insulin regimen that doesn’t match the patient’s actual physiology. Heart attacks present differently in women than in men and get mistaken for anxiety or gastrointestinal conditions. Multiple sclerosis shares symptoms with several less serious neurological conditions.

Errors also stem from misread imaging, misinterpreted lab results, or a differential diagnosis process that stops too early. When a provider anchors on the first plausible explanation without ruling out serious alternatives, the standard of care may not have been met.

What a New York Misdiagnosis Claim Must Prove

Not every wrong diagnosis is malpractice. A claim under New York law requires three things:

  • A doctor-patient relationship: The provider owed you a duty of care
  • A deviation from the accepted standard of care: A reasonably competent provider in the same field, under the same circumstances, would have reached a different or more careful diagnosis
  • Causation and harm: The incorrect diagnosis directly caused you injury, whether through wrong treatment, delayed correct treatment, or both

New York also requires most medical malpractice lawsuits to include a certificate of merit, a filing confirming that the attorney has consulted with a qualified medical professional who believes the claim has merit. We can coordinate that process as part of building your case.

Brooklyn Filing Deadlines for Misdiagnosis Claims

New York’s statute of limitations for medical malpractice is set out in CPLR 214-a. Most misdiagnosis claims must be filed within two years and six months of the negligent act or within two years and six months of the end of continuous treatment for the same condition. Missing this window generally means you may lose the right to pursue compensation.

Exceptions Brooklyn Residents Should Know

Two exceptions deserve particular attention. First, Lavern’s Law, named for a Brooklyn woman whose lung cancer went undiagnosed for years, created a discovery-rule exception for negligent failure to diagnose cancer. Under that exception, the clock can run from when the error was or reasonably should have been discovered, subject to a seven-year cap from the original negligent act. Second, claims against New York City public hospitals follow a different timeline: a notice of claim must be filed within 90 days, and the lawsuit itself must be filed within one year and 90 days. Misdiagnosis lawsuits arising in Brooklyn are generally filed in the Kings County Supreme Court, Civil Term.

What to Do If You Suspect a Misdiagnosis

Start by obtaining your complete medical records. Everything documented during the period of treatment, including imaging reports, lab results, and physician notes, becomes the foundation of a claim. A second opinion from a different provider can clarify whether the original diagnosis was consistent with accepted practice.

Consulting a misdiagnosis lawyer promptly matters in practical terms. Provider recollections fade, records require formal requests, and New York’s filing deadlines don’t pause while you decide. The earlier we can review what happened, the more complete a picture we can build.
