Fines & Driver Violations Points

To enforce texting and driving laws, New York issues tickets to drivers who are caught breaking these laws. Depending on your prior ticket history, you may be facing steep fines and multiple points on your driving record.

Fines for Texting and Driving:

  • First Offense: $50 to $200
  • Second Offense within 18 Months: $50 to $250
  • Third and Subsequent Offenses within 18 Months: $50 to $450

These violations also carry a penalty of 5 driver violation points. If you are a probationary driver or a junior driver (License classes DJ or MJ), your driver’s license or permit will be suspended for 120 days after your first offense. For a second offense within 6 months of the end of the 120-day period, you will lose your license for at least 1 year.
